A. Terms and Conditions - Use of Website

1. Introduction

Welcome to https://ib.cricket ("Site"). The website https://ib.cricket is owned and operated by ProYuga® Advanced Technologies Limited (“ProYuga®” or "Company" or "We" or "Our" or “Us” ), a company incorporated under the provisions of the Companies Act, 2013, with its registered office at Plot No. 30, Brigade Towers, East Wing, Ground Floor, Nanakramguda, Financial District, Gachibowli, K.V. Rangareddy, Serilingampally, Telangana, India, 500032. You (“User” or “You” or “Your”), whether as an individual or representing an entity, may be accessing our Site from a computer or mobile phone device (through an iOS or Android application, for example), and these Terms govern Your use of our Site and Your conduct, regardless of the means of access. These Terms govern Your use of the Product/Services owned by ProYuga® offered on the Site.

These Terms constitute an electronic record in accordance with the provisions of the Information Technology Act, 2000 and the Information Technology (Intermediaries guidelines) Rules, 2011 thereunder, as amended from time to time.

The Site contains information and resources provided by ProYuga® and certain third-party content providers. These Terms govern Your use of this Site exclusively. They do not apply to the use of any other ProYuga® websites, products, software, or services, nor do they modify or alter any other terms You may have, or enter into in the future, with the Company.

For the purposes of these Terms, "Product/Service" refers to the right granted by ProYuga® Advanced Technologies Limited to use the iB Cricket® Game software and/or the iB Cricket® Bat, either together or individually. This definition specifically excludes any third-party products or services, such as VR headsets or other accessories, that may be used in conjunction with the iB Cricket® Game but are not provided or sold directly by ProYuga®.

The Site is only to be used for Your personal non-commercial use or for commercial use based on the Product/Service that You are looking at on the Website.. Your use of the Site and features of the Site will be governed by these Terms and Conditions (hereinafter "Terms") along with the Privacy Policy, and the EULA, (together " Policies ") as modified and amended from time to time.

By merely accessing or using the Site, You are acknowledging, without limitation or qualification, to be bound by these Terms and any/orPolices, whether You have read the same or not. 

ACCESSING, BROWSING OR OTHERWISE USING THE SITE INDICATES Your UNCONDITIONAL AGREEMENT TO ALL THE TERMS AND CONDITIONS OF THIS SITE, SO PLEASE READ THIS Terms CAREFULLY BEFORE PROCEEDING.  Please do not use the Site if You do not agree to any of the terms enumerated in the Terms  and/or in any Policy(s) if any. You are responsible to ensure that Your access to this Site and material available on or through it are legal in each jurisdiction, in or through which You access or view the Site or such material.  

Company reserves the right to unilaterally change the particulars contained in the Terms and/or in any Policy(s) from time to time and at any time, in its sole discretion. Any change or modification to the Terms and the Policies will be effective immediately from the date of such upload of the Terms and Policies on the Site. Your continued use of the Site following the modifications to the Terms and Policies constitutes Your acceptance of the modified Terms and Policies, whether or not You have read them. For this reason, You should frequently review these Terms and the Policies, to understand the terms and conditions that apply to Your use of the Site. 

By accepting these Terms, You affirm that You are fully competent as mentioned in the Eligibility criteria below to enter into this Agreement and to abide by and comply with these Terms. If You are not competent to enter into this Agreement, You should not accept these Terms and Conditions.

2. Eligibility

  • 2.1 Age Requirement: The Site is not intended for children under the age of 13. If You are under 13, You should not access the Site or provide any information about Yourself, including but not limited to Your name, address, telephone number, or email address. 
  • 2.2 Consent for Minors: If You are considered a minor in Your country, You represent that You have Your parent or guardian’s permission to use the Service. Please have them read these Terms with You. If You are a parent or legal guardian of a minor in Your country, by allowing Your child to use the Site, You are subject to the Terms  and Privacy Policy and responsible for Your child’s activity on the Site. 
  • 2.3  Legal Capacity: By accessing or using the Site, You represent and warrant that You have the legal capacity to enter into and abide by these Terms. If You are accessing or using the Site on behalf of an organization, You represent and warrant that You are authorized to bind that organization to these Terms.
  • 2.4  Compliance with Laws: You must comply with all applicable laws and regulations while using the Site and Services. If You are located in a jurisdiction that restricts or prohibits Your access to the Site or Services, You must not use or access the Site
  • 3. Except as mentioned below, all information, content, material, trademarks, services marks, trade names, and trade secrets including but not limited to the software, text, images, graphics, video, script and audio, contained in the Website, Services and products and others (including all metadata associated with any content) are proprietary property of the Company (“Proprietary Information”). No Proprietary Information may be copied, downloaded, reproduced, modified, republished, uploaded, posted, transmitted or distributed in any way without obtaining prior written permission from the Company and nothing on this Application or Website or Services shall be or products deemed to confer a license of or any other right, interest or title to or in any of the intellectual property rights belonging to the Company, to the User. You may own the medium on which the information, content or materials resides, but the Company shall at all times retain full and complete title to the information, content or materials and all intellectual property rights inserted by the Company on such medium. Certain contents on the Website may belong to third parties. Such contents have been reproduced based on copyright license given with respect to such content and all rights relating to such content will remain with such third party. Further, You recognize and acknowledge that the ownership of all trademarks, copyright, logos, service marks and other intellectual property owned by any third party shall continue to vest with such party and You are not permitted to use the same without the consent of the respective third party.
  • 4. Your use of our Products, Website,  and Services is solely for Your personal non-commercial use or for commercial use based on the Product/Service that You are looking at on the Website  shall be subjected to the following restrictions:
    • 4.1 You may not decompile, reverse engineer, or disassemble the contents of the Website and/or Services/ products or modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information or software obtained from Website and/or Services/products, or remove any copyright, trademark registration, or other proprietary notices from the contents of the Application and / or and / or our Website and/or Services/products.
    • 4.2 You will not (a) use this Website and/or any of our product/s , or Service/s Your personal non-commercial use or for commercial use based on the Product/Service that You are looking at on the Website. or (b) advertise or sell the any products, Services or domain names or otherwise (whether or not for profit), or solicit others (including, without limitation, solicitations for contributions or donations) or use any public forum for commercial purposes of any kind, or (c) use the Website/our products and Services in any way that is unlawful, or harms the Company or any other person or entity as determined by the Company.
    • 4.3 No User shall be permitted to perform any of the following prohibited activities while availing our Services:
      • 4.3.1 Making available any content that is misleading, unlawful, harmful, threatening, abusive, tortious, defamatory, libelous, vulgar, obscene, child-pornographic, lewd, lascivious, profane, invasive of another’s privacy, hateful, or racially, ethnically or otherwise objectionable;
      • 4.3.2 Stalking, intimidating and/or harassing another and/or inciting other to commit violence;
      • 4.3.3 Transmitting material that encourages anyone to commit a criminal offence, that results in civil liability or otherwise breaches any relevant laws, regulations or code of practice;
      • 4.3.4 Interfering with any other person’s use or enjoyment of the Website/Services;
      • 4.3.5 Making, transmitting or storing electronic copies of materials protected by copyright without the permission of the owner, committing any act that amounts to the infringement of intellectual property or making available any material that infringes any intellectual property rights or other proprietary rights of anyone else;
      • 4.3.6 Make available any content or material that You do not have a right to make available under any law or contractual or fiduciary relationship, unless You own or control the rights thereto or have received all necessary consents for such use of the content;
      • 4.3.7 Impersonate any person or entity, or falsely state or otherwise misrepresent Your affiliation with a person or entity;
      • 4.3.8 Post, transmit or make available any material that contains viruses, trojan horses, worms, spyware, time bombs, cancelbots, or other computer programming routines, code, files or such other programs that may harm the Application/services, interests or rights of other users or limit the functionality of any computer software, hardware or telecommunications, or that may harvest or collect any data or personal information about other Users without their consent;
      • 4.3.9 Access or use the Application/Website/Services/products in any manner that could damage, disable, overburden or impair any of the Application’s/ Website’s servers or the networks connected to any of the servers on which the Application/Website is hosted;
      • 4.3.10 Intentionally or unintentionally interfere with or disrupt the services or violate any applicable laws related to the access to or use of the Application/ Website/Services/products, violate any requirements, procedures, policies or regulations of networks connected to the Website/Services/ products, or engage in any activity prohibited by these Terms;
      • 4.3.11 Disrupt or interfere with the security of, or otherwise cause harm to, the Website/Services/products, materials, systems resources, or gain unauthorized access to user accounts, passwords, servers or networks connected to or accessible through the Website/Services/ products or any affiliated or linked sites;
      • 4.3.12 Interfere with, or inhibit any user from using and enjoying access to the Website/ Services/products, or other affiliated sites, or engage in disruptive attacks such as denial of service attack on the Website/Services/products;
      • 4.3.13 Use deep-links, page-scrape, robot, spider or other automatic device, program, algorithm or methodology, or any similar or equivalent manual process, to increase traffic to the Website/Services/products, to access, acquire, copy or monitor any portion of the Website/Services/products, or in any way reproduce or circumvent the navigational structure or presentation of the site, or any content, to obtain or attempt to obtain any content, documents or information through any means not specifically made available through the Website/Services/products;
      • 4.3.14 Alter or modify any part of the Services;
      • 4.3.15 Use the Services for purposes that are not permitted by: (i) these Terms; and (ii) any applicable law, regulation or generally accepted practices or guidelines in the relevant jurisdiction; or
      • 4.3.16 Violate any of the terms specified under the Terms for the use of the Application /Website/Services/products.

5. Privacy Practices

We understand the importance of safeguarding Your personal information and we have formulated a Privacy Policy, to ensure that Your personal information is sufficiently protected. Apart from these Terms, the Privacy Policy will also govern Your visit and use of the Site. Your continued use of the Site implies that You have read and accepted the Privacy Policy and agree to be bound by its terms and conditions. You consent to the use of personal information by the Company in accordance with the terms  and purposes set forth in the Privacy Policy the same may be subject to amendment from time to time at the sole discretion of the Company.   

6. SITE USE, USER ACCOUNTS, AND CONTENT

  • 6.1 Site Availability and Access
    • 6.1.1 Site Use - The Site may not always be available. There may be interruptions or downtimes and You will be able to access the Website when available. Company  reserves the right to change or remove, and restrict or block access to, all or any part of the Site (including any features thereof) at any time without notice.
    • 6.1.2 Additional terms may be presented to You in connection with Your use of any feature on the site, or the downloading of material from the site or any service. You agree to comply with any additional terms, which are incorporated in these Terms by reference. If You do not agree to the additional terms, do not use or purchase the particular features to which the additional terms apply (if the terms are limited to specific features) or stop using the Site and terminate any related Service account. You may also be subject to additional terms and conditions from third parties that may apply when You purchase products or services or use or download software from third parties.
  • 6.2 User Accounts and Passwords 
    • 6.2.1 Account Registration & Safety - Some activities on this Site require You to register with a username and password (such as to join Cricket Lovers’ corner (if available)). If You register, You must provide the Company  with current, complete and accurate information. 
    • 6.2.2 You are responsible for maintaining the confidentiality of Your password and username. 
    • 6.2.3 You agree that if Your user name and password are used on the Site, Company may attribute that use to You and You will be legally bound by it and responsible for any and all activities that occur under Your account. 
    • 6.2.4 You agree to notify the Company immediately of any unauthorized use of Your account or any other breach of security at the email address support@ib.cricket
  • 6.3 User Conduct
    • 6.3.1 The Site may contain communication features (such as blogs, support forums, etc.) which enables You to communicate with the Company and the public at large. You agree to use the Site for its intended purposes only i.e. to post, send and receive messages and material that are appropriate and related to the purpose of the Site. 
    • 6.3.2 You should not misuse the Site by knowingly introducing viruses, trojans, worms or other material which is malicious or technically harmful. You must not attempt to gain unauthorized access to the Site, or any servers, computers, or any databases connected with the Site. 
    • 6.3.3 You must not attach the Site via a denial-of-service attack, or a distributed denial-of-service attack. 
    • 6.3.4 You agree that when using the Site, You will not engage or attempt to engage in any improper uses, as set out above and also as set out in the clause 4.3 . 
    • 6.3.5 If You breach this section, You may commit a criminal offense. The Company  will report any such breach to the relevant law enforcement authorities and we will cooperate with those authorities by disclosing Your name and any other relevant information that the Company  holds about You. In the event of such a breach, Your right to use the Site will cease immediately.
  • 6.4 If the Company suspects any violations relating to this section, the Company may bring legal proceedings against violators and proceed with legal action by cooperating with law enforcement authorities. You agree to cooperate with the Company in investigating suspected violations. The Company reserves the right to install, implement, manage and operate one or more software, monitoring or other solutions designed to assist in identifying or tracking activities that the Company considers to be illegal or violations of these Terms, to the extent such measures are allowed by applicable law.
  • 6.5 Third Party Materials
    • 6.5.1 The Site may contain links to third party web sites (“Linked Sites”). These Linked Sites are not under the Company's control and we are not responsible for any linked Site. We provide these links as a convenience and the inclusion of any link does not imply our endorsement or an association with its operators. 
    • 6.5.2 The copyright relating to content in linked sites will belong to the respective Third Party service providers. If You access a Linked Site, You do so at Your own risk. 
    • 6.5.3 Also, in the course of using a Product/Service offered through the Site, You may download to Your device, content that is provided by third parties or access services and Linked Sites provided by third parties, such as social media partners, wireless carriers, and third party software application developers. If You obtain anything from a third party over the Internet, directly or indirectly through the Site or a Service, including but not limited to applications, images, reports, any content or other materials and information for use ("Third Party Materials"), You understand that You receive such Third Party Materials from the third party supplier and not from the Company. Your relationship with respect to Third Party Materials is with the supplier, and not with the Company. It is Your responsibility to review the privacy policies & terms and conditions that apply to third party services, Linked Sites and Third Party Materials. Any claims You might have with respect to third party services, Linked Sites and Third Party Materials are against the supplier and not against the Company.
  • 6.6 Accuracy of Information
    • 6.6.1 This Site intends to represent current Company services and Products/Services, however, certain information may be outdated. 
    • 6.6.2 The Site is subject to change without notice and may contain typographical errors, inaccuracies or omissions. 
    • 6.6.3 The colors You see (for example, product colors) on the Site may depend on the specifications and settings of Your computer and may not accurately depict the actual colors. You agree not to rely on any information provided on this Site, which is provided for Your convenience only. The Company doesn’t guarantee the accuracy of information stated in the linked sites.
  • 6.7 User Generated Content
    • 6.7.1 Content Responsibility
      • 6.7.1.1 The Site may contain features (such as blogs, support forums, etc.) designed to enable users to communicate with the Company and the public at large, and Content may also be posted to the Site or particular Service by users.
      • 6.7.1.2 "User Content" means all information, graphics, text, images, software, sound files, video, communications and other materials, including all metadata associated with any content, that is posted to the Site or a Service by users of the Site except “Feedback”. 
      • 6.7.1.3 All User Content is considered to be non-confidential and non-proprietary. You are solely responsible for all User Content uploaded, downloaded, posted, emailed, transmitted, stored or otherwise made available by You or through Your account. 
      • 6.7.1.4 We may not control the User Content posted on the Site and it does not guarantee the accuracy, integrity or quality of any User Content. The Company reserves the right to determine whether any User Content is appropriate and in compliance with the applicable Terms, and may pre-screen, filter, restrict, block, move, refuse, modify or remove User Content at any time in its sole discretion, without prior notice.

  • 6.8 In In the event that any Product is out of stock, ProYuga® may, at its discretion, provide a "Notify Me" option on its Site. By selecting this option, You express Your interest in purchasing the Product including  All-in-One Home Kit when it becomes available. This does not constitute a reservation, guarantee of availability, or an obligation on ProYuga® to restock the Product.

    ProYuga® will make reasonable efforts to notify You when the Product is back in stock, subject to availability. However, ProYuga® is not liable for any inability to inform You or for the unavailability of the Product despite such notification.
7. The names and logos and all related product names, design marks and slogans are the trademarks, logos or service marks (hereinafter referred to as "Marks") of the Company or company have adequate license to use the same. No trademark or service mark license is granted in connection with the materials contained on this Site to You. Access to this Site does not authorize anyone to use any Marks in any manner. Marks displayed on this Site, whether registered or unregistered, of the Company are the intellectual property of the Company.
The Company expressly and exclusively reserve all the intellectual property rights in  text, programs, Products, processes, technology, content, software and other materials, that are the sole property of the Company, including its looks and feel,these materials do not include any third-party content, which remains the property of their respective owners and is used by the Company under appropriate licenses or permissions, where applicable and are protected by the Indian copyright laws and International treaties. To the maximum extent permitted by law, You agree to indemnify, defend, and hold harmless ProYuga®, including its affiliates, officers, directors, employees, agents, partners, licensors, and suppliers (collectively, the “Indemnified Parties”), from and against any and all claims, demands, liabilities, damages, losses, costs, or expenses, including reasonable attorneys' fees, arising out of or related to: (i) any third-party claim resulting from Your use of the Site, Products, Services, or any content You submit, post, or transmit; (ii) Your breach of these Terms or any related Policies, including any representations, warranties, or obligations; (iii) Your violation of any applicable laws, regulations, or third-party rights, including intellectual property, privacy, and publicity rights; (iv) any liability associated with content You make available through the Site or Services, including claims of defamation, privacy invasion, or intellectual property infringement; and (v) any unauthorized or improper use of Your account, including any actions due to Your failure to maintain confidentiality of account credentials. The Company reserves the right, at its expense, to assume the exclusive defense and control of any matter subject to indemnification, and You agree to cooperate fully with the Company in such defense. This indemnification obligation survives the termination or expiration of these Terms and Your use of the Site, Services, or Products.
9. To the fullest extent permitted by law, ProYuga®, including its affiliates, directors, officers, employees, agents, licensors, suppliers, and partners shall not be liable for any direct, indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to loss of profits, revenue, data, goodwill, or any other intangible losses, arising out of or in connection with (a) Your access to, use of, or inability to use the website, its content, or services; (b) any conduct or content of any third party on the website; and (c) unauthorized access, use, or alteration of Your transmissions or content, even if ProYuga® has been advised of the possibility of such damages.
In any event, ProYuga®’s total liability for all claims arising under these Terms shall be limited to the amount, if any, that You paid to the Company for access to or use of the website in the past twelve (12) months, or INR 5,000/- (Five Thousand Only), whichever is lower. Because some jurisdictions do not permit the exclusion or limitation of liability for certain types of damages, these limitations may not apply to You. This limitation of liability applies to all causes of action, whether in contract, tort (including negligence), statute, or otherwise, and reflects a fair allocation of risk between You and Company for use of the website.
10. In the event of Your breach of these Terms, You agree that the Company will be irreparably harmed and may not have an adequate remedy in money or damages. The Company therefore, shall be entitled in such event to obtain an injunction against such a breach from any court of competent jurisdiction. The Company’s right to obtain such relief shall not limit its right to obtain other remedies.
11. Any violation by You of the terms of this Clause may result in immediate suspension or termination of Your Accounts apart from any legal remedy that the Company can avail. In such instances, the Company may also disclose Your Account Information if required by any Governmental or legal authority. You understand that the violation of these Terms could also result in civil or criminal liability under applicable laws.
12. The Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Further, the Terms shall be subject to the exclusive jurisdiction of the competent courts located in Hyderabad  and You hereby accede to and accept the jurisdiction of such courts.

13. Termination

These Terms and Conditions for Use of Website  are effective unless and until terminated by either You or the Company.
You may terminate the Terms at any time, provided that You discontinue any further use of this Site. The Company may terminate the Terms  at any time and may do so without notice, and which it reasonably believes is unlawful, and accordingly deny You access to the Site, such termination will be without any liability to the Site. Termination of the Terms will also lead to the termination of the Policies
Upon any termination of the Terms  by either You or the Company, You must promptly destroy all materials downloaded or otherwise obtained from this Site, as well as all copies of such materials, whether made under the Terms or otherwise. Any such termination of the Terms will not cancel Your obligation to pay for the Product/Services already ordered from the Site or affect any liability that may have arisen under the Terms.

THE WEBSITE, APPLICATION, AND SERVICES ARE PROVIDED ON AN "AS IS" BASIS, WITH ALL FAULTS, AND WITHOUT ANY WARRANTY OF ANY KIND. THE COMPANY HEREBY DISCLAIMS ALL WARRANTIES AND CONDITIONS WITH REGARD TO THE WEBSITE, APPLICATION/PRODUCTS, AND THE SERVICES, INCLUDING, WITHOUT LIMITATION, ALL IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, TIMELINESS, PERFORMANCE, COMPLETENESS, SUITABILITY, AND NON-INFRINGEMENT.

14.2 Eligibility 

  • For purchase of any Product/Services from the Site, You are required to register an account. By registering an account and proceeding with a purchase, You affirm and warrant that:
    • You have attained the age of majority as per the laws of Your country of residence.
    • You possess the legal capacity to enter into a binding agreement and are eligible to purchase the Products or Services offered on this Site.
    If You are found to be ineligible, ProYuga® reserves the right to terminate Your account and cancel any orders placed without any liability.

    • Modification Restrictions: You shall not edit, merge, distribute, translate, reverse engineer, decompile, or disassemble the Product/Service or any of its parts.
    • Prohibited Exploits: Cheating, intentionally exploiting bugs or glitches, harassing or griefing other players, or using unauthorized software or tools to engage in any such activities related to Product/Service is strictly prohibited.
    • Anti-Bypass Measures: You are not allowed to bypass or remove any security measures implemented to prevent misuse or unauthorized access to the Product/Service
    • Legal Compliance: You shall not misuse the Product/Service in any way that violates applicable laws, rules, or accepted moral standards.
  • Online Conduct
    When using any online features of the Product/Service, You are expected to behave courteously and respectfully toward other users. This includes refraining from choosing offensive or inappropriate usernames or usernames that infringe upon the rights of others. ProYuga® reserves the right to take corrective actions, including changing Your username, restricting Your access to online features, or suspending or blocking Your account if these guidelines are violated.
  • Third Party Product Usage 
    ‍    You acknowledge and agree that the Product/Service may require or function in conjunction with third-party products or services (such as the Meta Quest VR Headset), which are not provided, owned, or controlled by ProYuga®. It is Your sole responsibility to ensure Your compliance with all applicable terms, conditions, safety and health guidelines  and obligations regarding such third-party products or services. ProYuga® shall have no liability or responsibility for any issues, malfunctions, damages, or any other form of loss arising from the use or misuse of such third-party products or services. You expressly agree to indemnify and hold ProYuga® harmless from any claims, demands, actions, damages, or liabilities arising from Your use of or interaction with such third-party products or services.

14.4 Health and safety warning

IMPORTANT: Read Carefully Before Using the iB Cricket® Home Edition

  • 14.4.1 ProYuga’s product/service is designed for use in conjunction with third-party virtual reality (VR) headsets, such as the Meta Quest 2. Please be aware that certain physical challenges or discomfort may arise not solely due to our product/service but as a result of using it with third-party VR hardware. ProYuga® is not liable for any discomfort, motion sickness, or injuries resulting from the use of third-party VR devices. To ensure a safe and enjoyable experience, please carefully follow these guidelines:
    • Evaluate Your Health: VR activities can be physically and mentally demanding. If You have any health conditions or concerns, please consult a physician before using this product/service.
    • Follow Manufacturer Guidelines for Headset Use: Always ensure Your VR headset is properly fitted and used according to the manufacturer's safety instructions. Inadequate fitting or improper use of third-party VR devices can lead to discomfort, dizziness, or potential injuries.
    • Take Regular Breaks: Continuous use of VR can lead to eye strain, fatigue, or physical stress. We strongly recommend taking regular breaks to reduce the risk of discomfort or strain.
    • Stay Hydrated: Immersive VR experiences can make users lose track of time and may lead to dehydration. Please keep water nearby and drink as needed.
    • Cease Use If Discomfort Occurs: If You experience nausea, dizziness, or any discomfort while using the headset, stop immediately and take a break.
    • Refer to the VR Headset Manufacturer’s Safety Instructions: For additional guidance, please review the safety and health guidelines provided by the VR headset manufacturer, as ProYuga® cannot assume responsibility for issues related to third-party hardware.
    The virtual-reality nature of Product/Service used in conjunction with third-party VR headsets can be physically challenging . Please consider Your state of health before You start playing. Ensure that the headset is properly fitted and used according to the manufacturer's instructions. If You have any doubts, consult a physician . Take breaks regularly and stay hydrated.
    While using third-party VR headsets such as the Meta Quest 2, please follow all safety and health guidelines provided by the manufacturer of the VR headset. ProYuga® is not liable for any discomfort, motion sickness, or injuries resulting from the use of third-party VR devices.

  • 14.4.2 Please be mindful of Your environment when using the Product/Service, especially while using the iB Cricket® Custom Designed Bat with virtual reality (VR) systems. Always ensure that:
    • The safety strap for the  iB Cricket® Custom Designed Bat is secured as demonstrated in the help section video.
    • You set up Your VR headset carefully by following the walkthrough of the headset installation and setup. You watch the game walkthrough carefully to understand proper usage and safety for the iB Cricket Bat.
    • There is at least 8 feet x 8 feet of clear space around You to safely swing the iB Cricket® Custom Designed Bat without hitting any objects, walls, or people.
    Additionally, clear Your play area of any obstacles, furniture, or sharp objects that could cause injury during gameplay.
  • 14.4.3 Please note that You bear responsibility for Your actions while using Product/Service. We don't take responsibility for any injury or damage caused by Your actions while using Product/Service
  • 14.4.4 If You are a minor (below the legal age of majority in Your country), please have the health and safety concerns checked by Your parent or another responsible adult person before You start to use the Product/Service
  • 14.4.5 Please note that in case of non adherence to any terms and conditions of EULA while using Product/Service, we will not be responsible for any cost, damages and other liabilities arising out of but not limited to health and safety.

14.5 Exactness of the Product

Although we have made every effort to display the colors accurately, we cannot guarantee that Your computer's display of the colors accurately reflects the color of the items. 14.6 Pricing

  • 14.61 We ensure that all details of prices appearing on the website are accurate, however errors may occur. If we discover an error in the price of any Product/Service which You have ordered, we will inform You of this as soon as possible. If we are unable to contact You, we will treat the order as canceled. 
  • 14.6.2 If a payment transaction is not successfully processed and is shown as canceled on our website, we will not receive the corresponding amount. In such cases, if an amount has been deducted from Your bank account, it is processed by Your bank, and we have no control over this transaction.
  • 14.6.3 The products/services available on this site are licensed strictly for personal, end-user consumption and are intended solely for retail use. The license granted to You does not include any rights for resale, redistribution, or sublicensing. Any attempt to resell or distribute these products/services without explicit authorization from ProYuga® is prohibited and may result in the termination and potential legal action.
  • 14.6.4 Additionally, prices for Product/Service may change from time to time at the sole discretion of the Company. However, these changes will not affect orders that have already been ordered.
  • 14.6.5 The price of a Product/Service includes GST (or similar sales tax) at the prevailing rate for which we are responsible as a seller. Please note that the prices listed on the website are only applicable for items purchased on the website and not through any other source.

14.7 Payment Terms

  • 14.7.1 Upon receiving Your order, we carry out a standard pre-authorization check to ensure that payment is successful. Product/Service will not be dispatched, granted until this pre-authorization check has been completed.
  • 14.7.2 In case of failed transactions where an amount is debited from Your account but is not credited to the ProYuga® 's account, the amount will be automatically credited to Your account within 10 to 12 working days by the third party providers. If there is a delay in the auto-refund, You will have to escalate the issue with Your issuing bank and Your bank should be able to assist You on the retrieval of the funds .Please note that the ProYuga® cannot facilitate or intervene in this matter and is not liable for any delays or issues arising from transactions handled by Your bank
  • 14.7.3 In case of any disputes raised by You, Product/Service will not be dispatched, granted until the dispute is resolved.

15. Delivery and Shipping Policy

  • 15.1 All our Products are eligible for free delivery within India. We collaborate with a select number of delivery partners to ensure efficient order fulfillment. 
  • 15.2 Once Your order is shipped, You will receive an email and SMS with the estimated delivery date and tracking information.
  • 15.3 For security purposes, our delivery process requires authorization through a One-Time Password (OTP). You must share the OTP with the delivery partner to receive Your product. It is Your responsibility to ensure that the address and mobile number provided during the order process are accurate. The ProYuga® is not liable for any delays or non-delivery resulting from incorrect information.

15.4 Delivery Timeline

  • 15.4.1 An order is shipped within 3-5 business days and typically delivered within 7-10 business days.
  • 15.4.2 While we strive to deliver orders on time, delivery may occasionally take longer due to unforeseen circumstances, such as weather conditions, natural disasters, or logistical challenges. Delivery may also be affected by non-business days, regional or national holidays. The ProYuga® appreciates Your understanding in such situations.
  • 15.4.3 ProYuga® is not responsible for any delays in delivery and cannot provide compensation for delays.

      • Currently, the All-in-One Home Kit is not available for shipping outside India.
      • The below mentioned Refund and Replacement Policy is not applicable for international customers.

16. Refund and Replacement Policy

  • 16.1 Product/Service purchased on the iB Cricket Official Website are non-refundable. However, replacement for the iB Cricket Custom Designed Bat and Meta Quest 2 may be provided as per the terms and conditions outlined. 
  • 16.2 Replacement requests are considered only if notified to us within 48 hours of successful delivery.
  • 16.3 Acceptable replacement reasons include:
    • Physical Damage during Transit
    • Defective Product
    • Wrong Item
    • Missing Item
  • 16.4 Once the Company receives the request over email, the support team will guide You through a diagnostic process to determine the issue with the defective device and provide a resolution based on the diagnostic results.
  • 16.5 The decision taken by the company is final and binding.
  • 16.6 No replacement will be issued if the damage is determined to have been caused by the user.
  • 16.7 For any replacement, please keep the item in its original condition (i.e. the condition in which it was delivered to You), with brand outer box, and all the contents received from the manufacturer packaging.
  • 16.8 In certain cases if there isn’t pickup service by our delivery partners the customer shall have to send the defective piece to us through a courier with proper packaging and printout of invoice.

        2. By using the Oculus/Meta Quest 2* You agree to all terms of service set forth by Oculus/Meta.
        3. Oculus/Meta product devices are not covered by any warranty in India
        *Important Notice: ProYuga® assumes no liability for any issues arising from the use of the Oculus/Meta Quest 2 headset. Any claims, concerns, or warranty issues should be addressed directly to the manufacturer.

        *Please be aware that the Oculus/Meta Quest 2 is not a product of ProYuga®. It is powered by Meta, and all rights to this device are held by Meta.
      2. iB Cricket® 5 Profile Game: You will receive full access to the iB Cricket® 5 Profile Game, which supports up to five unique user profiles. Each profile allows users to save their individual game progress, track their stats, and achieve milestones, enhancing the overall gaming experience.
        1. Includes Game with 5 User Profiles: Each profile can save progress, stats, and achievements, enabling a personalized experience for every player.
        2. Requires Oculus/Meta Quest 2: The game is compatible with the Oculus/Meta Quest 2 headset.
        Please note that while multiple logins across different devices are permitted, only one user can actively play the game at any given time. Each user profile can save progress, stats, and achievements, but simultaneous gameplay from multiple profiles is not supported.

    • Age Restriction

    • Activation and Download

      Note 2: While You may log into multiple Meta headsets using Your Meta account, only one user can actively engage in gameplay at a time. Due to Meta's usage restrictions, concurrent gameplay across multiple devices using the same account or application is not permitted.

D. Metaverse Super StarTM Terms and Conditions

These Terms & Conditions (“Terms”) of Metaverse Super StarTM("League"), are between You (“You”) and ProYuga® Advanced Technologies Limited (“Company/We/Us/Our”)

  1. Acceptance of Terms and Conditions
    By participating or registering in the League, You agree to be bound by these Terms and Conditions. If You don’t not agree with any of these Terms and Conditions, You should not register or participate in the League.
  2. Eligibility

    The League is open to individuals who are at least eighteen (18) years of age or older at the time of registration, unless participation is prohibited by law in the respective country of the user. The League is void where prohibited or restricted by law. However, Individuals below the age of 18 years but above 13 years can participate in the League subject to obtaining parental consent from their Legal Guardian/Parents in the manner as may be prescribed by the Company.
    By participating in the League, You represent and warrant that You meet the eligibility requirements set forth herein and agree to be bound by these Terms and Conditions. Participation in the League is free of cost and open to anyone who meets the eligibility criteria.

  3. Registration

    You must register for the League through the designated registration process as specified by the Company. Registration may require providing personal information, including but not limited to name, age, gender and contact information. You must provide accurate and up-to-date information during registration, and any false or misleading information may result in Your disqualification from the League. 

  4. League Format
    The League shall be conducted in multiple stages. To participate in the next stage, You must have successfully qualified in the previous stage and have been notified of Your qualification by the Company.
    The specific rules related to each stage including but not limited to, individual game(s) format, round(s), schedule shall be determined and communicated by the Company from time to time.
    You must familiarize Yourself with and adhere to the League format, rules, and regulations, including any updates or changes communicated by the Company during the League. The Company reserves the right to modify the format and structure of the League without prior notice, at their sole discretion.
    The decision of the Company shall be final and binding with respect to any disagreements or disputes over issues such as rules, scoring, or Your behavior.
  5. Fair Play

    You must compete in the League with integrity and in a sportsmanlike manner. Cheating, hacking, exploiting, or any other form of unfair play is strictly prohibited and may result in Your disqualification from the League, forfeiture of prizes, and potential legal actions. You must also not engage in any behavior that may disrupt or interfere with the League or other Players' experiences.

  6. User Conduct

    You must conduct Yourself in a proper manner during the League. Prohibited conduct includes but is not limited to:

    • Using any form of cheats, hacks, or other unauthorized third-party software (if applicable) in connection with the League;
    • Attempting to gain an unfair advantage over other Players, including but not limited to colluding with other Players or intentionally exploiting or manipulating game mechanics or allowing others to play on Your behalf;
    • Engaging in any form of harassment or hate speech towards other Players or the Company;
    • Engaging in any form of gambling or betting on the outcome of the League or any individual match within the League;
    • Sharing, selling, or otherwise distributing Your account or any of the credentials associated with Your account with any other party.
  7. Any Player found to be engaging in prohibited conduct will be disqualified from the League and may be subject to further legal action as deemed necessary by the Company.
  8. Health and Safety

    Due to its virtual reality nature, the game can be physically challenging. You must consider Your state of health before entering the League. You are suggested to consult a physician in case of any doubts.

    You are requested to be careful and mindful of Your environment while participating in the League. Further, You shall ensure there is enough space to play safely and that there are no obstacles or dangerous objects around You.

    By accepting these terms, You agree that You bear complete responsibility for Your actions while participating in the League. The Company is not responsible for any injury or damage caused by Your actions while participating in the League.

    If You are a minor (below the legal age of majority in Your country), You should get the health and safety concerns checked by Your parent or another responsible adult person before You enter the League.

    Please note that in case of non adherence to any of the above terms and conditions, we will not be responsible for any cost, damages and other liabilities arising out of but not limited to health and safety.

  9. Privacy

    By participating in the League, You give Your consent to collect, use and store Your personal information, including but not limited to name (first name, middle name, and last name), username or similar identifier, title or designation, date of birth, gender, age, photographs, videos, testimonials, gameplay footage, game profile including score and game track record, Govt. authorized identity proofs, etc., with the Company and other stakeholders for the purpose of organizing, promoting, and broadcasting the League. You consent to the collection, use, and disclosure of Your personal information for such purposes and acknowledge that Your personal information may be subject to the Company’s Privacy Policy.

  10. Intellectual Property

    All rights, title, and interest in and to the League, including without limitation any and all intellectual property rights therein and thereto, are and shall remain the exclusive property of the Company. You agree not to use any of the League's intellectual property for any purpose other than participating in the League, and agree not to reproduce, modify, or create derivative works based on any of the League's intellectual property without the express written consent of the Company. Any unauthorized use of the League's intellectual property may result in legal action by the Company.

  11. Rewards and Prizes

    The Company may offer rewards or prizes of any form to the winners of the League as communicated by the Company from time to time.

    By participating in the League, You agree to abide by the below rules and regulations governing the prize money and rewards, as well as the decisions of the Company:

    • The prize money and rewards are subject to change at the discretion of the Company without prior notice.
    • The Company reserves the right to withhold any prize money or reward if the winning Player is found to have violated any of the applicable laws, and terms and conditions of the League.
    • The prize money and rewards will be distributed to the winners as per the rules and regulations of the League.
    • The winners will be responsible for all applicable taxes and fees associated with receiving the prize money and rewards unless otherwise specified by the Company.
    • The Company will not be responsible for any loss or damage caused to the prize money or rewards during delivery.
    • The winners of the League may be required to provide valid identification, proof of age and any other documents as necessary before receiving the prize money or rewards.
    • In the event that a winner is unable to receive the prize money or reward, the Company may, at their discretion, award the prize money or reward to another Player.
    • The prizes or rewards are non-transferable, non-exchangeable, or non-redeemable for cash unless otherwise specified by the Company.
    • The decision of the Company regarding the prize money and rewards shall be final and binding on all participants.
  12. Liability

    You participate in the League at Your own risk and acknowledge that the League activities may involve risks of injury, illness, or other harm. You release the Company, their affiliates, employees, agents, or any other assigns or stakeholders from any liability for any loss, damage, injury, or harm arising from Your participation in the League or use of equipment required to participate in the League. You are responsible for ensuring Your own physical and mental well-being during the League.
    You acknowledge and agree that the Company is not liable for any loss, damage, injury or harm arising out of the technical glitches, bugs or issues with the game and virtual reality platform including but not limited to lag, connectivity problems, or hardware failures.

  13. Disputes
    Any and all disputes, claims, and controversies arising from or relating to the League, including, but not limited to, issues of eligibility, registration, gameplay, rules, prizes, or any other matter, will be resolved at the sole discretion of the Company. The decision of the Company shall be final and binding on all Players and participants. By participating in the League, You agree to abide by the decisions of the Company, and to waive any and all objections to such decisions, including any claim that such decisions are arbitrary, capricious, or made in bad faith. You further agree not to engage in any public statements or actions that may disparage or harm the reputation of the Company or any other participants in the League.
    In case of any disputes, You may contact the Company by sending an email to mss_support@ib.cricket. The Company will make reasonable efforts to promptly investigate and resolve any issues raised in a fair and impartial manner. However, You acknowledge and agree that the Company's decisions in such matters shall be final and binding.
  14. Modification or Termination:
    The Company reserves the right to modify, suspend, or terminate the League and/or the League’s Terms and Conditions at any time, for any reason, without notice. The Company may, in their sole discretion, modify or revise these Terms and Conditions from time to time by updating this posting, and without any additional notice. The most current version of these Terms and Conditions will supersede all previous versions. It is Your responsibility to check the Terms and Conditions periodically for modifications. If You do not agree to the modified Terms and Conditions, the only recourse is to discontinue Your participation in the League by sending an email to the Company to the email address mentioned in the Notices section.
    In case of any modification or termination, the Company shall not be liable to You or any other players, third party for any damages, losses, or expenses incurred in connection with the modification or termination of the League or these Terms and Conditions. The Company, at its sole discretion, also reserves the right to disqualify any Player who violates these Terms and Conditions or who acts in an unsportsmanlike or disruptive manner during the League.
  15. Indemnification

    You agree to indemnify, defend, and hold harmless the Company, its affiliates, and their respective officers, directors, employees, agents, and other representatives from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees and court costs) arising out of or in connection with the Your participation in the League, breach of these Terms and Conditions, violation of any law or the rights of a third party, or use of any third-party services or materials.

  16. Customer Care:

    We make all best endeavors to provide You with a pleasant experience throughout the League. In the unlikely event that You face any issues, You can contact the Company at mss_support@ib.cricket and the company shall address You at the earliest possible.

E. MCS End User License Agreement

Please read and understand the terms of the agreement and You should abide by the terms of the agreement

  1. General
    1.1  The agreement is a contract between You and PROYUGA ADVANCED TECHNOLOGIES LIMITED (hereinafter “Company” or "iB Cricket"), governing Your use of our iB Cricket® Game.
    1.2  This agreement applies to the iB Cricket® Game and all of its future updates and expansions, unless the expansion is governed by a separate agreement.
    1.3  If You are a minor (below the legal age of majority in Your country), please have the agreement reviewed and agreed to by Your parents or legal guardian.
    1.4  By this agreement You certify that You are of legal age of majority in the jurisdiction in which You reside or if You are between the ages of 13 and the legal age of majority, that You are using the iB Cricket® Game with the supervision of Your parent or legal guardian who agrees to be bound by these terms of service with Your parent or guardian so that both understand all Your rights and obligations.
    1.5  We reserve the right to change or modify these Terms on a go-forward basis at any time and at our sole discretion.If we make any changes, we may provide notice by updating the "Last Updated" date at the top of these Terms.
  2. Definitions
    2.1  “Metaverse Cricket Stadium (MCS)” shall mean, an iB Cricket® Stadium established at MCS Location;
    2.2  “MCS Location” refers to the locations that are designated by the Company or its business partners as MCS
    2.3  “iB Cricket® Game” means and includes the Virtual Reality cricket game developed by ProYuga and offered to You to play at the MCS Location.
  3. Health and safety warning
    3.1  Due to its virtual-reality nature, the iB Cricket® Game can be physically challenging. Please consider Your state of health before You start playing. If You have any doubts, consult a physician. Take breaks regularly and stay hydrated
    3.2  Please be careful and mindful of Your environment when playing the iB Cricket® Game. Always make sure there is enough space for You to play safely and that there are no obstacles or dangerous objects around You.
    3.3  If You are a minor (below the legal age of majority in Your country), please have the health and safety concerns checked by Your parent or another responsible adult person before You start to play the iB Cricket® Game.
    3.4  Please note that You bear responsibility for Your actions while You play the iB Cricket® Game. We don't take responsibility for any injury or damage caused by Your actions while playing the iB Cricket® Game.
    3.5  Please note that in case of non adherence to any terms and conditions of EULA while playing the iB Cricket® Game we will not be responsible for any cost, damages and other liabilities arising out of but not limited to health and safety.
  4. Intellectual Property
    4.1  You acknowledge that the goodwill and all other rights associated with the Intellectual Property vest absolutely with iB Cricket and that it is the intention of the Parties that all such rights will at all times hereafter and for all purposes remain vested in iB Cricket. And in the event that any such rights at any time accrue to You by operation of law or howsoever otherwise, You will at Your own expense forthwith on demand do all such acts and things and execute all such documents as iB Cricket shall deem necessary to vest such rights absolutely in iB Cricket. In case the Intellectual Property goes to You, You shall immediately inform iB Cricket about the transfer and subsequently initiate the re-transfer process to the Company as communicated. Without limitation to the foregoing, You acknowledge that the requirements, specifications, directions, standards, practices and procedures, in relation to the iB Cricket® Game, as communicated by the Company to You from time to time, shall remain the absolute and exclusive property of the Company. Further, without prejudice to the generality of this clause, You, during the Term of this Agreement shall:
    4.1.1  use and affix to any materials bearing the Intellectual Property, such clear and prominent statements and legends as may be directed and/ or approved by Company from time to time in writing, identifying the Company or ProYuga or its Affiliates as the owner(s) or licensee(s) of the Intellectual Property, and indicating that the Intellectual Property are used under license from Company (including, in the case of use of those Intellectual Property which are registered, indicating that the Intellectual Property are registered);
    4.1.2  not sell, assign, transfer, charge or sub-license the Intellectual Property or any part thereof, or any of the Your rights or obligations under this Agreement, without the prior written consent of the Company;
    4.1.3  not without the prior written consent of Company, use or apply in any manner whatsoever, including on or in relation to the iB Cricket® Game, any name, trade mark, indicia, logo or other proprietary or commercial name or designation which is or is in Company’s opinion identical or confusingly similar to the Intellectual Property or incorporates the Intellectual Property;
    4.1.4  not register or attempt to register in any territory (including the MCS Location) any of the Intellectual Property or any name or designation, including domain names and URLaddresses, comprising or incorporating any of the Intellectual Property or any part thereof or any other name or designation which is or is in Company’s opinion identical or similar to the Intellectual Property, be it in English, Hindi or any other translation in any other languages, without the prior written consent of Company. You shall, upon Company’s request, and at Company’s expense (subject to Company’s prior written approval of the same), execute any instrument that may be necessary or appropriate to register, maintain or renew the registration of the Intellectual Property in Company’s (or its nominee’s) name in the MCS Location, and shall keep Company regularly informed of any cost or expense incurred, or likely to be incurred, in connection with the same;
    4.1.5  not do, cause or authorize to be done anything which will or may impair, damage or be detrimental to the reputation or goodwill associated with Company, the iB Cricket® Game, the Intellectual Property or the Products, or which will or may adversely affect the value or validity of the Intellectual Property or bring the iB Cricket® Game into disrepute;
    4.1.6  not use its own names or trademarks, or any other Person’s names or trademarks, in connection with the management or operation of the MCS, without the prior written approval of the Company.
  5. License Terms and Ownership
    5.1  We grant You the right to access the iB Cricket® Game at the MCS location upon payment of the specified fee, for a specific purpose and for the specified duration as agreed.
    5.2  You may not do the following with the iB Cricket® Game at the MCS:
    5.2.1  Use the iB Cricket® Game for any commercial purpose without our prior consent or unless specifically permitted in this Agreement.
    5.2.2  Grant access to another person to play the iB Cricket® Game without our authorization.
    5.2.3  Copy or reproduce the iB Cricket® Game or any associated materials.
    5.2.4  Sell, rent, lease, or otherwise distribute the iB Cricket game or any related content.
    5.2.5  Modify, reverse engineer, decompile, disassemble, or attempt to derive the source code of the iB Cricket® Game.
    5.2.6 Engage in any form of cheating, exploiting bugs or glitches, harassing other users, or using unauthorized software or methods to gain advantages in the iB Cricket® Game.
    5.2.7 Circumvent or remove any measures implemented to prevent misuse or unauthorized access to the iB Cricket® Game at the MCS.
    5.2.8 Misuse the iB Cricket® Game in any way that violates applicable laws or goes against good moral standards.
    5.3  We reserve the right to provide updates, patches, and modifications to the iB Cricket® Game at the MCS to maintain its functionality, address any issues, or enhance the gameplay experience.
    5.4  While playing the iB Cricket® Game at the MCS, please be respectful and considerate towards other users. Use appropriate language and refrain from using offensive or inappropriate usernames. We reserve the right to take necessary actions, such as modifying Your username, restricting access to online features, or suspending Your access to the iB Cricket® Game, if any violations occur.
  6. Refund and Validity:
    6.1  The purchase made for playing the iB Cricket® Game at a specific store or MCS is only valid for that particular location. It cannot be transferred or used at any other store or MCS.
    6.2  The purchase is valid only for the day of purchase. If unutilized, it cannot be carried forward to a different day or redeemed at a later time.
    6.3  Please note that all purchases made for playing the iB Cricket game at the MCS are non-refundable. Once the payment is made, no refunds or exchanges will be provided, irrespective of the duration or outcome of the gameplay.
  7. Equipment Handling and Responsibility:
    7.1  You shall handle the iB Cricket hardware, including the bat and headset, with due care and diligence, as per the instructions given. It is Your responsibility to use the equipment responsibly and prevent any damages or misuse.
    7.2  You shall not intentionally damage, tamper with, or misuse the iB Cricket hardware. Any damages caused to the hardware due to Your negligence or intentional actions shall be Your sole responsibility.
    7.3  In the event of any damages to the iB Cricket hardware caused by You, You may be held liable for repair or replacement costs as determined by the MCS.
  8. Liability
    8.1  We grant You all the rights under this agreement to the iB Cricket game "as is" and "as available". That means that we do not grant You any guarantee that the iB Cricket® Game works without any bugs, glitches, or other issues. In as much as the applicable law permits, we don't take any responsibility or liability for the iB Cricket® Game having any bugs, glitches, or other issues.
    8.2  We warrant to You that we have the right to conclude this agreement with You and that we have the right to grant You the rights under this agreement (namely the license to use the iB Cricket game).
  9. Termination
    9.1  If You materially breach this agreement, we have the right to terminate the agreement without any notice period. If it comes to this, You will lose all the rights granted by this agreement, namely the right to use the iB Cricket® Game, whereas we shall have no further obligations to You stemming from this agreement.
  10. Feedbacks
    10.1  You can give any feedback in connection with Your use of the iB Cricket® Game, including, for example, suggested functionality, Your personal opinion about the content of the App and ideas for improvement of the game (“Feedbacks“). By submitting Your Feedback, You hereby grant the Company a worldwide, irrevocable, non-exclusive, royalty-free, perpetual, sub licensable and transferable license to use, for any purpose, copy, reproduce, distribute, display, perform, edit, modify, prepare derivative works of, and incorporate any such Feedback in connection with our game, products and our business. You hereby waive any moral rights in Your Feedback, to the extent permitted by law. The Company has complete discretion whether or not Your Feedback will be used.
  11. Governing law and dispute resolution
    11.1  These Terms shall be governed by and construed in accordance with the laws of India, specifically the laws applicable in the state of Telangana. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Hyderabad, Telangana.
  12. Amendments
    12.1  We reserve the right to make changes to this agreement. In such a case, we will post the changes and amended text of the agreement online and take reasonable steps to draw Your attention to it.
    12.2  The changes shall come into effect (become legally binding) immediately we post the amended agreement online, unless a longer period is stipulated in the amendment. If You don't agree to the changes, You can terminate this agreement by simply ceasing to use the iB Cricket® Game. If You continue to use the iB Cricket® Game after the changes have come into effect, it shall be construed that You agree to the amended agreement in its entirety.
  13. Other legal matters
    13.1  You may not assign this agreement or any of the rights granted in the agreement to another person.
    13.2  In as much as the applicable law permits, the provisions of this agreement shall be interpreted to the fullest extent expressed in this agreement. If any of the provisions of this agreement is deemed to be void, inapplicable, or unenforceable, the remaining provisions shall not be affected.

  15. 1+1 Game Offer
    By redeeming the offer and participating in the iB Cricket game, customers agree to abide by these terms and conditions.
    15.1  The 1+1 iB Cricket game offer is valid for a two (2) over game only for customers who receive a WhatsApp message from iB Cricket. Eligible customers have the privilege to extend the +1 offer to another person of their choice, allowing them to enjoy the game.
    15.2  The offer is applicable from Monday to Thursday at any of the participating MCS Locations (Flyzone AMB Mall, Flyzone Gandipet, Iron hill Kukatpally) in the Hyderabad city.
    15.3  To avail the offer, customers must show the WhatsApp message received from iB Cricket at any of the above mentioned locations.
    15.4  The offer is limited to one redemption per customer per day.
    15.5  The operator at the MCS Location has the right to decide the validity of the offer based on the presented WhatsApp message. The operator reserves the right to deny the offer if the message is not valid, altered or forwarded from other whatsapp numbers.
    15.6  During busy hours, customers may experience wait times before playing the game. The availability of iB Cricket game slots is subject to the MCS Location’s schedule and capacity.
    15.7  The 1+1 offer cannot be combined with any other ongoing promotions or discounts.
    15.8  The offer is not applicable on public holidays or special event days unless otherwise stated.
    15.9  Customers must adhere to the rules and regulations of the MCS Location while participating in the iB Cricket game. Any misconduct or violation of MCS Location rules may result in the customer being asked to leave the premises.
    15.10  This offer is valid for a limited period and can be discontinued or modified by iB Cricket without prior notice.
    15.11  iB Cricket is not responsible for any loss, damage, or injury incurred during the gameplay.
    15.12  These terms and conditions are subject to change, and any modifications will be updated through Whatsapp message
  • 19. General Provisions:
    1. Notice: All notices served by the Company shall be provided via email to Your account or as a general notification on the Application. Any notice to be provided to the Company should be sent to support@ib.cricket
    2. Entire Agreement: The Terms, along with the Privacy Policy, and any other guidelines made applicable to the Application from time to time, constitute the entire agreement between the Company and You with respect to Your access to or use of the Product/Services, Website and the Services thereof.
    3. Governing Law and Jurisdiction:
      The Terms & Condition shall be construed in accordance with the applicable laws of India. For proceedings arising therein the Courts at  Hyderabad shall have exclusive jurisdiction.
      Any dispute or difference either in interpretation or otherwise, of the Terms  and other Policies on the Site, between the parties hereto, shall be referred to an independent arbitrator who will be appointed by mutually and his decision shall be final and binding on the parties hereto. The above arbitration shall be in accordance with the Arbitration and Conciliation Act, 1996 as amended from time to time. The seat and venue of arbitration shall be held in Hyderabad.
      Without any prejudice to particulars listed in Clause 6.7.3 above, Company shall have the right to seek and obtain any injunctive, provisional or interim relief from any court of competent jurisdiction to protect its trade-mark or other intellectual property rights or confidential information or to preserve the status quo pending arbitration.
      For disputes relating to orders outside India, International arbitration rules of Indian Arbitration and Conciliation Act 1996 shall apply. The seat and venue of international arbitration shall be Hyderabad
    4. Assignment: You cannot assign or otherwise transfer Your obligations under the Terms, or any right granted hereunder to any third party. The Company’s rights under the Terms are freely transferable by the Company to any third parties without the requirement of seeking Your consent.
    5. Severability: If, for any reason, a court of competent jurisdiction finds any provision of the Terms, or portion thereof, to be unenforceable, that provision shall be enforced to the maximum extent permissible so as to give effect to the intent of the parties as reflected by that provision, and the remainder of the Terms shall continue in full force and effect.
    6. Waiver: Any failure by the Company to enforce or exercise any provision of the Terms, or any related right, shall not constitute a waiver by the Company of that provision or right.
    7. Relationship: You acknowledge that Your participation in the Website or Your purchase of any Product/Service  does not make You an employee or agency or partnership or joint venture or franchise of the Company.
    8. The Company provides these Terms so that You are aware of the terms that apply to Your use of the Website and Products/Services. You acknowledge that the Company has given You a reasonable opportunity to review these Terms and that You have agreed to them.
    9. Amendment: The Company has the right to change, modify, suspend, or discontinue and/or eliminate any aspect(s), features or functionality of the Site or the Products/Services as it deems fit at any time without notice. Further, the Company has the right to amend these Terms from time to time without prior notice to You. The Company makes no commitment, express or implied, to maintain or continue any aspect of the Site. You agree that the Company shall not be liable to You or any third party for any modification, suspension or discontinuance of the Application/Services. All prices are subject to change without notice.Your continued use, access, or browsing of the Application or Website, use of the Services or products, or registration by any means constitutes Your acceptance of these updated Terms and Your agreement to be legally bound by them. The updated Terms take effect from the date they are published on the Website.
    10. Please note that despite any changes to these Terms and Conditions, the specific provisions regarding the Product Terms, Return & Replacement and Warranty for the Products/Services, will continue to apply AS IS. These provisions remain in effect as they were, irrespective of any updates to these Terms unless otherwise.
  • 20. Feedback:
    Any feedback You provide with respect to the Products and Services shall be deemed to be non-confidential. The ProYuga shall be free to use such information on an unrestricted basis. Further, by submitting the feedback, You represent and warrant that (i) Your feedback does not contain confidential or proprietary information of You or of third parties; (ii) the Company is not under any obligation of confidentiality, express or implied, with respect to the feedback; (iii) the Application may have something similar to the feedback already under consideration or in development; and (iv) You are not entitled to any compensation or reimbursement of any kind from the Company for the feedback under any circumstances, unless specified.
    Under no circumstances shall the Company be held responsible in any manner for any content provided by other users even if such content is offensive, hurtful or offensive. Please exercise caution while accessing the Application.
